Privacy Policy

By creating an account or using DOTNudge(“the Service”), you agree to these Terms. Please read them carefully — they allocate responsibility for compliance matters to you, the user.

1. What DOTNudge is

DOTNudge is an informational calendar and reminder application. It stores dates you provide or that are extracted from documents you upload, organizes them, and sends you reminder notifications. DOTNudge is NOT a regulatory agency, compliance consultant, law firm, filing service, or insurer, and it does not guarantee compliance with any law or regulation.

2. Your sole responsibility for compliance

You are solely and fully responsible for: (a) ensuring that all information entered into or extracted by the Service is accurate and complete; (b) verifying every deadline, requirement, and filing obligation directly with the applicable authority (including the Federal Motor Carrier Safety Administration, state agencies, and your insurance providers); and (c) taking all actions necessary to remain compliant, including renewing, filing, paying, and obtaining any required documents, permits, licenses, or coverage.

The Service does not (and is not intended to) replace official communications from regulators, your medical examiner, insurer, or any government agency. You should not rely on the Service as your only source of information about your obligations.

3. No legal, tax, or regulatory advice

The Service does not provide legal, tax, accounting, or regulatory advice. Anything in the Service, including checklists, reminders, links, descriptions of requirements, or suggested dates, is provided for general informational purposes only and may be incomplete, outdated, or incorrect. Never make decisions based solely on information from the Service. Consult qualified professionals and official sources for advice.

4. No filings on your behalf

DOTNudge does not register, file, pay, or submit anything on your behalf — including MCS-150 updates, UCR registration, IFTA filings, Form 2290, IRP, or any other filing. Where the Service links to official portals, it is only a convenience link; you remain responsible for completing any transaction with the relevant authority and for any fees, penalties, or consequences that result.

5. Accuracy of the Service is not guaranteed

The Service may contain errors, including misread dates from uploaded documents (which are extracted by automated tools), incorrect reminder delivery, or delayed or failed notifications. Email and SMS delivery is not guaranteed. You acknowledge that:

  • Automated extraction of dates from documents may be wrong; you must verify all extracted data.
  • Reminders may be delayed, filtered as spam, or never delivered.
  • You remain responsible for tracking your obligations even if the Service fails to notify you.

6. No warranty

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. We do not warrant that the Service will meet your needs or that it will prevent any fine, penalty, out-of-service order, audit failure, or other adverse outcome.

7. Limitation of liability

To the maximum extent permitted by law, DOTNudge, its owners, and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including fines, penalties, out-of-service orders, lost revenue, lost profits, lost loads, downtime, or damage to reputation — arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you actually paid us in the three (3) months preceding the claim. To the extent any jurisdiction does not permit a limitation of liability, our liability is limited to the greatest extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless DOTNudge, its owners, employees, and service providers from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) your failure to comply with any law or regulation; (c) any data you provide or upload; (d) your violation of these Terms; or (e) any enforcement action, inspection, or audit involving your operations.

9. Accounts and data accuracy

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. You are responsible for the accuracy of all documents, dates, and data you enter or upload.

10. Subscriptions, trial, and payments

The Service is offered on a subscription basis. Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. A 14-day free trial is offered with no card required; no charge occurs at trial end. Billing begins when you complete Checkout, and paid subscriptions renew on that anniversary until you cancel. When your subscription ends, reminder notifications continue for a 30-day grace period, then pause until you resubscribe. You can cancel anytime through the billing portal or by contacting us. No refunds are provided for partial subscription periods. Prices may change with notice.

11. Acceptable use

You agree not to: misuse, reverse engineer, or attempt to gain unauthorized access to the Service; upload illegal content or content you do not have the right to share; interfere with the Service or other users; or use the Service in violation of any law. We may suspend or terminate accounts that violate these Terms.

12. Intellectual property

The Service, its design, content, and software are owned by DOTNudge or its licensors. You may not copy, modify, or redistribute them except as expressly permitted. You retain all rights to the documents and data you upload.

13. Termination

You may stop using and delete your account at any time. We may suspend or terminate your access for violation of these Terms or for conduct we reasonably determine is harmful. Upon termination, your rights to use the Service end; you may export your data before termination if available.

14. Third-party services and links

The Service may link to third-party websites, including government portals and payment processors. We do not control and are not responsible for those services. Use of third-party services is at your own risk and subject to their own terms.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. We encourage you to contact us first to resolve any issue informally. Any dispute not resolved informally will be resolved by binding individual arbitration, and you waive the right to participate in any class action or representative proceeding. If any provision is held invalid, the remainder remains in effect.
